Hikari respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (DMCA). This page explains our policy for handling copyright infringement claims related to content on our website. If you believe your copyrighted material has been used improperly, or if you’ve received a takedown notice, please follow the procedures below.

1. Reporting Copyright Infringement

If you are a copyright owner (or an authorized representative) and believe that material on our website infringes your copyright, you may submit a written DMCA takedown notice to our designated Copyright Agent. Your notice must include the following:

  • A physical or electronic signature of the copyright owner or their authorized agent.
  • Identification of the copyrighted work claimed to have been infringed (e.g., a URL or description).
  • Identification of the material that is allegedly infringing, including its location on our site (e.g., a specific URL).
  • Your contact information, including name, address, phone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

2. Our Response to Takedown Notices

Upon receiving a valid DMCA takedown notice:

  • We will promptly remove or disable access to the allegedly infringing material.
  • We will notify the user who posted the content (if applicable) of the removal and provide them with your notice.
  • We may take additional steps, such as terminating repeat infringers’ access to our services, in accordance with our policies and applicable law.

3. Filing a Counter-Notice

If you believe your content was removed in error or misidentification, you may submit a counter-notice to our Copyright Agent. Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled, including its prior location on our site.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to a mistake or misidentification.
  • Your name, address, phone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any district where we may be found if you’re outside the U.S.), and that you will accept service of process from the claimant.

4. Our Response to Counter-Notices

Upon receiving a valid counter-notice:

  • We will forward it to the original claimant who filed the takedown notice.
  • If the claimant does not notify us within 10 business days that they have filed a legal action seeking a court order to restrain the alleged infringer, we may restore the removed material at our discretion.

5. Repeat Infringers

We reserve the right to terminate accounts or access for users who are determined to be repeat infringers, in accordance with the DMCA and our internal policies.
